Terms of Service

By accessing, browsing, or using the SmsGate platform ("Service"), including any associated websites, applications, or services, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), along with our Privacy Policy.

If you do not agree to these Terms, you must immediately cease all use of the Service. Your continued access or use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

To use SmsGate, you must meet the following requirements:

• You must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater.
• You must have the legal capacity to enter into a binding agreement.
• You must not have been previously suspended or removed from the Service.
• You must not be located in, or a national or resident of, any country subject to applicable trade sanctions or embargoes.
• If registering on behalf of a business or organization, you must have the authority to bind that entity to these Terms.

To access certain features of SmsGate, you must create an account by providing accurate, current, and complete information during the registration process. You agree to:

• Maintain the confidentiality of your account credentials, including your password.
• Immediately notify us of any unauthorized access to or use of your account.
• Accept full responsibility for all activities that occur under your account, whether authorized or not.
• Not share, transfer, or sell your account to any other person or entity.
• Keep your registration information up to date.
• Use only one account per person — creating multiple accounts to abuse promotions, credits, or free trials is strictly prohibited.

SmsGate reserves the right to suspend or terminate any account that appears to be in violation of these Terms or for any other reason at our sole discretion.

SmsGate is a platform that provides users with access to real, non-VoIP phone numbers for the purpose of receiving SMS verification codes. Our Service enables you to:

• Rent temporary or long-term real phone numbers from various countries.
• Receive SMS verification codes sent by third-party platforms such as Google, Amazon, eBay, Facebook, WhatsApp, and many others.
• View incoming SMS messages on your SmsGate dashboard in real time.
• Choose phone numbers from multiple countries and carriers to suit your verification needs.
• Access a history of received verification codes and past number rentals.
• Use our platform through the web interface or API for automated verification workflows.

We provide real, carrier-based (non-VoIP) phone numbers to maximize compatibility with platforms that reject virtual or VoIP numbers during verification.

We reserve the right to modify, update, suspend, or discontinue any aspect of the Service at any time, with or without notice, without liability to you or any third party.

When renting or using phone numbers through SmsGate, you acknowledge and agree to the following:

• Temporary Access: Unless you purchase a long-term rental, phone numbers are provided on a temporary basis. Once your rental period expires, the number may be reassigned to another user.
• No Ownership: You do not own any phone number rented through SmsGate. Numbers remain the property of SmsGate and our carrier partners.
• SMS Receive Only: Phone numbers provided are for receiving SMS messages only. You cannot use them to make or receive calls, or to send outbound SMS messages.
• Shared Numbers: Some lower-cost numbers may be shared among multiple users. If you require exclusive access, you must select a dedicated or private number option where available.
• Number Recycling: Previously used numbers may be recycled and reassigned. SmsGate is not responsible for messages received from prior users' accounts or services.
• Availability: Number availability varies by country, carrier, and demand. We cannot guarantee that a specific number, country, or carrier will always be available.

You agree to use SmsGate only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You must ensure that:

• You use phone numbers solely for legitimate account verification purposes on third-party platforms.
• You do not use the Service to circumvent bans, suspensions, or restrictions imposed on you by any third-party platform.
• Your use of the Service does not violate the terms of service of the platforms where you are verifying accounts.
• You do not use the Service to create accounts for fraudulent, deceptive, or illegal activities.
• You do not abuse or attempt to exploit the platform's pricing, credit system, or promotional offers.

You are strictly prohibited from using SmsGate for the following purposes:

• Creating accounts on third-party platforms for the purpose of fraud, scams, phishing, identity theft, or any other illegal activity.
• Mass-creating fake accounts or bot accounts on any platform.
• Using the Service in connection with money laundering, terrorism financing, or any sanctioned activities.
• Attempting to bypass or circumvent security measures, fraud detection systems, or identity verification processes of any third-party service.
• Harassing, threatening, defaming, or abusing any individual or group using accounts verified through our Service.
• Reselling, redistributing, or sublicensing phone numbers or access to the Service without written authorization.
• Reverse-engineering, decompiling, or disassembling any part of the Service.
• Using automated tools (bots, crawlers, scrapers) to access the Service without our express written permission.
• Interfering with or disrupting the Service, servers, or networks connected to the Service.
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.

SmsGate provides phone numbers that can be used to receive SMS verification codes from various online platforms. Please be aware of the following:

• Platform Compatibility: While we strive to maintain compatibility with popular platforms (Google, Amazon, eBay, Facebook, Twitter/X, WhatsApp, Telegram, etc.), we cannot guarantee that every number will work with every platform at all times.
• Platform Changes: Third-party platforms may update their verification systems, block certain number ranges, or change their policies at any time without notice to us. This may affect the usability of our numbers on those platforms.
• No Affiliation: SmsGate is not affiliated with, endorsed by, or connected to any of the third-party platforms mentioned. All platform names and trademarks are the property of their respective owners.
• Success Rate: Verification success depends on many factors outside our control, including the target platform's policies, the country of the number, carrier restrictions, and current platform behavior. We do not guarantee a 100% success rate.
• Code Delivery: SMS codes are typically delivered within seconds to minutes, but delivery times can vary depending on the sending platform and carrier network conditions.

SmsGate operates on a credit-based and/or subscription-based payment model. By purchasing credits or subscribing to a plan, you agree to the following:

• Credits: Credits are purchased in advance and are deducted when you rent a phone number or activate a verification. Credit prices and the cost per number vary by country, carrier, and number type.
• Pricing: All prices are displayed in USD unless otherwise stated. Prices are subject to change and may vary based on demand, availability, and country.
• Payment Methods: We accept major credit cards, debit cards, cryptocurrency, and other payment options as displayed during checkout.
• Non-Transferable: Credits and subscriptions are non-transferable and tied to your account.
• Failed Payments: If a payment fails, your credit balance will not be updated and you will need to retry or use a different payment method.
• Taxes: Prices are exclusive of applicable taxes and fees unless explicitly stated otherwise. You are responsible for any taxes applicable in your jurisdiction.

Our refund and cancellation policy is as follows:

• Failed Verifications: If a rented number fails to receive the SMS verification code within the specified time window, the credits spent on that number may be automatically refunded to your account balance.
• Used Numbers: Once a verification code has been successfully received and displayed, no refund will be issued for that transaction.
• Credit Purchases: Purchased credits are generally non-refundable. Exceptions may be made at our sole discretion in cases of billing errors or documented technical failures.
• Subscription Cancellations: You may cancel your subscription at any time. Access will continue until the end of the current billing period.
• Refund Requests: To request a refund for exceptional circumstances, contact our support team within 7 days of the transaction.

The credit and rental system works as follows:

• Credit Expiration: Credits may have an expiration period as specified at the time of purchase. Expired credits cannot be recovered or refunded.
• Rental Duration: Each phone number rental has a specific duration (e.g., 5 minutes, 20 minutes, 1 hour, 30 days). The rental period begins as soon as the number is assigned to you.
• Extensions: Some number rentals may be extended for an additional fee, subject to number availability.
• Long-Term Rentals: Long-term or dedicated number rentals renew automatically at the end of each billing cycle unless cancelled in advance.
• Credit Balance: Your credit balance is displayed on your dashboard. It is your responsibility to monitor your balance and purchase additional credits as needed.
• Promotional Credits: Bonus or promotional credits may be subject to additional terms and conditions, including usage restrictions and expiration dates.

All content, features, and functionality of SmsGate — including but not limited to the software, text, graphics, logos, icons, images, data compilations, and the design, selection, and arrangement thereof — are the exclusive property of SmsGate and its licensors, protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for its intended purpose, subject to these Terms. This license does not include the right to:

• Modify, copy, or create derivative works based on the Service.
• Use the Service's trademarks, logos, or branding without prior written consent.
• Sublicense, sell, resell, or commercially exploit any part of the Service.
• Extract or scrape data from the platform for use outside the Service.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of your data in accordance with our Privacy Policy. You also acknowledge that SMS verification codes received through our platform may be visible to SmsGate and, in the case of shared numbers, potentially to other users. You should not use our Service if the confidentiality of a verification code is critical to your security.

SmsGate is an independent service and is not affiliated with, sponsored by, or endorsed by any third-party platform, including but not limited to Google, Amazon, eBay, Facebook, Twitter/X, WhatsApp, Telegram, or any other service. You acknowledge that:

• Third-party platforms have their own terms of service, and it is your responsibility to understand and comply with them.
• SmsGate is not responsible for any actions taken by third-party platforms against your accounts, including suspensions, restrictions, or bans.
• We have no control over third-party platforms' verification systems, number blocking policies, or anti-fraud measures.
• Links or references to third-party platforms are provided for informational purposes only and do not imply endorsement.

We endeavor to maintain a high standard of service availability. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when feasible).
• Emergency maintenance or security patches.
• Force majeure events (natural disasters, wars, pandemics, etc.).
• Carrier outages, telecommunications failures, or number supply shortages.
• Unexpected technical issues, third-party API failures, or system overloads.

SmsGate shall not be liable for any damages, losses, or claims arising from service interruptions, number unavailability, or performance degradation.

SmsGate provides phone numbers as a tool for receiving SMS verification codes. However, we explicitly do not guarantee that:

• Any specific phone number will work with any specific platform or service.
• Verification codes will be delivered within a specific timeframe or at all.
• A phone number will not be blocked or flagged by a third-party platform.
• An account created using our numbers will remain active or in good standing on any platform.
• Numbers will be available in every country or from every carrier at all times.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, SMSGATE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
• WARRANTIES THAT PHONE NUMBERS WILL BE COMPATIBLE WITH ANY PARTICULAR PLATFORM OR SERVICE.
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION.
• WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE IS FREE OF VIRUSES OR HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SMSGATE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities.
• Loss or suspension of third-party accounts verified through our Service.
• Inability to verify accounts on any specific platform.
• Loss of goodwill or reputation.
• Any damages resulting from unauthorized access, alteration, or transmission of your data.

In any case, our total aggregate liability shall not exceed the greater of (a) the total amount paid by you to SmsGate during the twelve (12) months preceding the claim, or (b) fifty US dollars ($50.00).

You agree to indemnify, defend, and hold harmless SmsGate, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use or misuse of the Service.
• Your violation of these Terms or any applicable law or regulation.
• Your violation of any third-party platform's terms of service.
• Any accounts you create, verify, or manage using phone numbers obtained through our Service.
• Any claim that your use of the Service caused damage to a third party.
• Any illegal or fraudulent activities conducted using our Service.

Either party may terminate this agreement at any time, subject to the following conditions:

• By You: You may terminate your account at any time through your account settings. Any remaining credits will be forfeited upon account deletion unless otherwise stated.
• By SmsGate: We may suspend or terminate your account immediately, without prior notice or liability, if you breach any provision of these Terms, engage in prohibited activities, or if we determine that your conduct poses a risk to the Service or other users.

Upon termination, your right to use the Service will immediately cease. All active number rentals will be cancelled, and unused credits will be forfeited. Provisions relating to ownership, disclaimers, indemnification, and limitation of liability shall survive termination.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, the parties agree to follow this resolution process:

1. Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us at our support email. We will endeavor to resolve your concern within 30 business days.
2. Mediation: If the dispute cannot be resolved informally, either party may initiate mediation through a mutually agreed-upon mediator.
3. Binding Arbitration: If mediation fails, any remaining dispute shall be resolved by binding arbitration in accordance with the rules of the applicable arbitration authority in the governing jurisdiction.

You agree to resolve disputes on an individual basis and waive your right to participate in a class action, class arbitration, or representative proceeding.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SmsGate is registered, without regard to its conflict of law provisions. Any legal proceedings arising out of or related to these Terms shall be brought exclusively in the courts located within that jurisdiction, and you hereby consent to the personal jurisdiction of such courts.

SmsGate reserves the right to modify, update, or replace these Terms at any time. When we make changes, we will:

• Update the "Effective Date" at the top of this page.
• Notify you via email or through an in-app notification for material changes.
• Provide at least 30 days' notice before significant changes take effect.

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service and close your account.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

The failure of SmsGate to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver will be effective only if in writing and signed by an authorized representative of SmsGate.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SmsGate regarding the use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
